PREAMBLE :
The Seller operates an e-commerce business and offers an online sales service for Products on the website www.apt-curation.com. These terms and conditions (hereinafter referred to as "Conditions") are exclusively reserved for consumer Buyers and not professional Buyers.
Article 1: Definitions Buyer:
Individual purchasing Products through the Site. Article 2: Purpose:
The purpose of these Conditions is to define the rights and obligations of the Seller and the Buyer in connection with the sale of Products through the Site.
Article 3: Scope of application:
These Terms and Conditions apply to all sales of Products by the Seller to the Buyer made through the Website. www.apt-curation.com reserves the right to adapt or modify these Terms and Conditions of Sale at any time. In the event of modification, the Terms and Conditions of Sale in effect on the date of the order will apply to each order. An order will only be processed by the Seller after the Buyer has accepted these Terms and Conditions.
Article 4: Order:
The Buyer places their order via the Website. All contractual information is presented in French and English and will be confirmed no later than at the time of delivery.
Article 4.1: Order validation:
The Buyer declares having read the Terms and Conditions prior to placing their order and acknowledges that validating their order implies acceptance of these terms. The Buyer further acknowledges that the Terms and Conditions are made available to them in a manner that allows for their storage and reproduction, in accordance with Article 1369-4 of the French Civil Code. To place an order, the Buyer must provide the Seller with their personal data and complete an online form accessible from the Website. Until the final step, the Buyer will have the opportunity to return to previous pages and correct or modify their order and the information previously provided. A confirmation email, acknowledging receipt of the order and summarizing all this information, will then be sent to the Buyer as soon as possible. The Buyer must therefore provide a valid email address when filling in the fields relating to their identity.
Article 4.2: Validity of the offer – Product unavailability:
The offers presented by the Seller on the Website are valid as long as they are visible on the site, subject to availability. Product photographs and descriptions are for illustrative purposes only and may be subject to slight modifications without incurring any liability on the part of the Seller or affecting the validity of the sale. Upon receipt of the order, we check the availability of the ordered product(s). Should a product ordered by the Buyer be unavailable, the Seller undertakes to inform the Buyer by email as soon as we become aware of this unavailability. In the event of unavailability, we undertake to offer you either an exchange or a refund within 30 days of order confirmation. If one of the products in your order is out of stock, we will ship the remainder of your order.
Article 5: Price, payment and taxes:
The prices of the Products shown on the Site pages include VAT but exclude any contribution to logistics and shipping costs. Please note, however, that APT ships all its packages via DAP (Delivery at Place). In some cases, the carrier may contact you to collect an import tax. Each country has a different policy regarding import fees; this tax is therefore specific to each country, and we are unable to calculate its amount in advance. If you do not wish to pay this tax, you must contact the carrier to refuse the package. It will then be returned to us, and we will refund you less the initial shipping costs. The Seller reserves the right to modify the prices of the Products displayed on the Site. However, the Products will be invoiced to the Buyer based on the prices in effect at the time the order is validated.
Article 5.1: Payment terms:
Payment for the order will be made by credit card: payment is processed through a secure banking server at the time of the order. This means that no banking information passes through the www.aptcuration.com website. Therefore, credit card payments are completely secure; personal information transmitted from the www.aptcuration.com website to the processing center is protected and encrypted using SSL (Secure Socket Layers); the order will be registered and validated as soon as the payment is accepted by the bank. Credit card payments cannot be canceled. Therefore, the Buyer's payment for the order is irrevocable, without prejudice to the Buyer's right to withdraw from or subsequently cancel the order.
Article 5.2: Transfer of ownership:
Ownership of the Product will only transfer to the Buyer upon full payment of the price by the Seller. However, from the moment the customer receives the order, the risk of loss or damage to the delivered goods is transferred to the customer.
Article 5.3: Default of payment:
APT reserves the right to refuse to make a delivery or to fulfill an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is being administered.
Article 6: Delivery:
APT ships all its packages via DHL. Shipping costs are calculated based on the destination; they are automatically displayed when you confirm your order and are included in the total price. However, if the shipping address is outside DHL's service area, the carrier may charge us an additional "Remote Area" fee when generating the shipping label. If this is the case, our support team will contact you to arrange payment of the difference and confirm the shipment. The product will be delivered to the address provided by the Buyer on the order form. All delivery times are calculated in business days. The Seller commits to processing the order within thirty days from the day after order confirmation. If the shipping deadline is exceeded, the order may be canceled as long as it has not yet been shipped from our warehouses. To do so, simply contact our customer service department. If you receive the package: refuse it and request a refund from our customer service department. As soon as we receive confirmation of your package's return, we will issue a refund within 15 days. The stated delivery times are average times and correspond to the processing, preparation, and shipping time of your order (departure from our warehouses). They begin from the moment the order is validated. The carrier's delivery time must be added to this. Products always travel at the recipient's risk. In case of delay, damage, or missing items, the recipient must file a claim against the carrier or make the necessary reservations with the carrier to allow for such a claim. If the product is delivered after the order has been canceled, the refund will be issued upon receipt of the product by the Seller in its original condition. The return of the product and the Buyer's refund will be processed under the conditions outlined below in Article 7.
Article 7: Cancellation, withdrawal, refund
Article 7.1: Right of Return:
To ensure proper identification and optimal processing of returns, any product requiring return must be the subject of a return request submitted to our customer service department, otherwise it will be refused. Return requests must be sent to our customer service department at support@lelabostore.com. You will receive an email confirming receipt of your return request. Once you receive confirmation, you have 15 days to return the product. After this period, your return will be refused. We recommend using a tracked DHL service for your return. Please note that we are not responsible for any packages not shipped by us. Only the sender of the package can initiate an investigation with the shipping company. To process your request correctly, please provide your order number and complete contact information. Upon receipt, our team will verify the returned product's condition and the reason for the return. If the returned product is not in its original condition, it will be refused and returned to you at your expense. Any return that incurs customs duties will be automatically refused.
Article 7.2: Right of return for withdrawal:
Upon receipt of the product, the Buyer has a 14-day withdrawal period during which they may return the delivered product without having to provide any specific reason. If the Buyer exercises this right within 14 days of receiving the product, the Seller undertakes to reimburse the Buyer without delay and at the latest within thirty days of the date on which this right was exercised. The Seller is not responsible for the return shipping costs; these costs remain the responsibility of the Buyer. The initial shipping costs are non-refundable under any circumstances. The Buyer will be reimbursed for the total purchase amount, less the initial shipping costs. The product must be returned in perfect condition, in its original packaging, undamaged, unmarked, and with all accessories. Otherwise, the product will be returned to you at your expense. To exercise this right, the Buyer must first contact customer service at support@lelabostore.com.
Article 7.3: Returns due to reference errors:
You have 15 days to notify us if the product received is not the one you ordered: incorrect item number, size, color, or specifications; a different or defective product. Our customer service team will then issue you a return authorization number. The product must be returned in good condition and in its original packaging with all its contents (accessories, instructions, etc.). After we receive and accept your package, depending on the nature of the product, available stock, and your preference, we will offer to resend you the originally ordered product or an equivalent replacement. If you choose a refund, the full amount of your order (product(s) + shipping costs) will be credited back to the account you used for payment within 15 days of your return being accepted.
Article 8: Warranty:
Without prejudice to the aforementioned right of withdrawal, the Buyer benefits from the warranty against hidden defects as provided for in Article 1641 of the French Civil Code. Furthermore, if the Product received by the Buyer does not conform to the Product specified in their order, this Product will be replaced or refunded, according to the Buyer's preference.
Article 9: Responsibility:
The Seller's liability is limited to direct and foreseeable damages that may result from the Buyer's use of the Website and the delivered Products. The Seller shall not be liable if the non-performance or improper performance of its obligations is attributable to the Buyer, to the unforeseeable and insurmountable act of a third party unrelated to the provision of the services stipulated in these Terms and Conditions, or to an unforeseeable, irresistible, and external event of force majeure. The Seller shall not be liable for damages resulting from the Buyer's negligence in the use of the Products.
Article 10: Intellectual Property:
All elements published on the Site, such as sounds, images, photographs, videos, texts, animations, programs, graphic design, utilities, databases, and software, are protected by the provisions of the Intellectual Property Code and belong to the Seller. The Buyer is prohibited from infringing the intellectual property rights relating to these elements and, in particular, from reproducing, representing, modifying, adapting, translating, extracting, and/or reusing a qualitatively or quantitatively substantial part thereof, except for acts necessary for their normal and intended use.
ARTICLE 11 – PERSONAL DATA
The Buyer is informed that, during browsing and in connection with the Order, personal data concerning them is collected and processed by the Seller. This processing is subject to a declaration to the French Data Protection Authority (CNIL) in accordance with Law No. 78-17 of 6 January 1978. The Buyer is informed that their data: – is collected fairly and lawfully, – is collected for specified, explicit and legitimate purposes, – will not be further processed in a manner incompatible with these purposes, – is adequate, relevant and not excessive in relation to the purposes for which it is collected and further processed, – is accurate and complete, – is kept in a form which permits identification of the data subjects for no longer than is necessary for the purposes for which it is collected and processed. The Seller also undertakes to take all necessary precautions to ensure the security of the data, and in particular to prevent it from being distorted, damaged or accessed by unauthorized third parties. This data is used to process the Order and to improve and personalize the services offered by the Seller. It is not intended to be shared with third parties. The Buyer has the right to object to the processing of their personal data and to its use for marketing purposes, including commercial prospecting. The Buyer may contact the Seller to obtain confirmation as to whether or not their personal data is being processed, information regarding the purposes of the processing, the categories of personal data processed, and the recipients or categories of recipients to whom the data is disclosed, as well as a copy of the personal data concerning them and any available information regarding its origin. The Buyer may also require the Seller to rectify, complete, update, block, or erase any personal data concerning them that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, disclosure, or storage is prohibited. To exercise this right, the Buyer must send an email to the Seller, in its capacity as data controller, at the following address: support@lelabostore.com.
Article 12: Convention on Evidence:
It is expressly agreed that the Parties may communicate with each other electronically for the purposes of these terms and conditions, provided that technical security measures are implemented to guarantee the confidentiality of the data exchanged. Both Parties agree that emails exchanged between them shall constitute valid proof of the content of their communications and, where applicable, of their commitments, particularly with regard to the transmission and acceptance of orders.
Article 13: Partial invalidity:
If one or more of the provisions of the Conditions were deemed unlawful or void, this invalidity would not have the effect of rendering the other provisions of the Conditions void, unless those provisions were inextricably linked to the invalidated provision.
Article 14: Applicable Law:
These Terms and Conditions are governed by French law.
Article 15: Allocation of powers:
The Parties agree that in the event of any dispute arising concerning the performance or interpretation of these Terms and Conditions, they will endeavor to reach an amicable settlement. Should this attempt at amicable resolution fail, the dispute will be brought before the competent courts. The competent jurisdiction is that of the Seller's registered office (Romans).

Your transferred personal data will be processed in accordance with Klarna's privacy policy.
